I.                   This policy is promulgated pursuant to California Code of Regulations, Title 24, Part 9, Appendix, Chapter 1,  Sections 13916(a),(b) and 17951.b Health and Safety Code.

II.               The basis for the fee structures utilized by the District are established for cost recovery purposes and are imposed utilizing Government Code Section 66016.

III.            The general methodology for computation of cost per incident is established on approximately an annual basis.  The District utilizes the California Office of Emergency Services Fire and Rescue Branch Annual Salary Survey and Calculation Methodology.  This document utilizes the Districts actual operational cost and a standardized cost calculation format.  The District will apply this calculation to the nearest minute.  Cost not included in the actual survey will be determined at their fully burdened cost, consistent with the survey methodology by the Chief of the District.

 

Purpose:

IV       To reimburse the impacts to the general operational costs from the following unmitigated impacts:

A.        Operational impacts caused by criminal acts adjudicated by the court requiring restitution analysis.

B.        Exceptional operational and or chronic impacts caused by grossly negligent acts as determined by the District or adjudication.

C.        Operational impacts that are determined exceptional and or chronically reoccurring that occur on properties not within the boundaries of a fire district or on properties not mitigated by tax funding or fee arrangements that support the aforementioned impacts.

D.        Vehicle collisions involving non residents of Eldorado County.

Policy:

V         The District will determine the correct liability category for mitigation from Policy 605b, section IV. The basis for the bill will be the incident report.  The billing clerk may utilize the FC-34 as a reference document.  This policy will not be utilized for resources hired by other agencies or funded by separated sources, e.g. Ambulances. The Board of Directors shall, with the intent of expressing current real cost, as needed, revise, amend or review EXHIBIT A, and Policy 605 Section V at a regularly noticed meeting of the Board of Directors 

A.        Properties having liability under Section 605b IV C. will be noticed of the commencement of this program thirty days prior to the initiation of billing.

B.        Calculation formula basis (Average Actual Rate (AxHx1.5) + (AxHx1.5xW) +M+E) x S) Where A =Average Actual Rate; H = Total hours or fraction on incident; W = The workers compensation rate (%); U = State employment rate (%); S = Surcharge rate (%) B = Established hourly base rate; E = Equipment rate.  Variables will be applies to the calculation as a result of the resources utilized on the incident.

C.        An alternative calculation may be utilized when using third party billing service.
