I.         Purpose        

To assure that the District’s legal interest are protected during non-criminal interviews of employees and to maintain a record of these interviews.

II.        Policy

It is the intent of the District to provide all employees with appropriate representation during non-criminal depositions, interrogatory statements or investigative interviews.

A.                Employees shall refrain from volunteering statements to anyone other than sworn peace officers.

B.                Employees shall advise the appropriate supervisor upon receiving a subpoena or other request for statement or testimony.

            III.      The District will evaluate the request for the interview, statement or testimony and will assign the appropriate level of representation based on the nature of investigation, focus and experience of the employee.  This will include one of the following:

A.                District council.

B.                Staff representation

C.                Peer representation.

D.                Self representation.

 IV.      Note:  This policy will apply to investigative or disciplinary efforts by the El Dorado County Emergency Services Agency with exceptions applied to:

A.        Exception is applied for those structured meetings and events commonly attended to by this District.
